Terms of Service

These Terms govern your use of skimoschool.com (and any other domains we operate), the Skimo School mailing list, coaching services delivered under the Skimo School name, Mountain Metrics, and any other services we offer under the Skimo School or Sagittura names (collectively, "the Services"). By using any Service, you agree to these Terms.

Who we are

1082704 LLC is a Delaware limited liability company doing business as Skimo School and Sagittura. The business is run by Scott Semple, residing in Vermont, USA.

Eligibility

You must be at least 16 years old to use any of our Services. By using a Service, you confirm you meet this requirement.

Your account and your data

Where a Service requires authentication (e.g., Mountain Metrics via Strava OAuth), you are responsible for maintaining the security of your credentials. You retain ownership of your data; our handling of it is governed by our Privacy Policy.

You may delete your data and disconnect at any time, as described in the Privacy Policy.

Acceptable use

You agree not to:

  • Resell, sublicense, or commercially redistribute any of our Services or their outputs
  • Reverse-engineer, decompile, or attempt to extract source code beyond what is provided in our public repositories
  • Use any Service to harm Strava, its users, its platform, or any other third party
  • Attempt to gain unauthorized access to other users' data or to systems running our Services
  • Use any Service to violate any law, regulation, or third-party right
  • Misrepresent yourself or your data
  • Interfere with or disrupt the integrity or performance of the Services

Content you provide

If you provide us with content (e.g., training notes, support inquiries, mailing-list contributions), you grant us a non-exclusive license to use that content as necessary to operate the Services and respond to you. You retain all underlying rights.

No warranty

The Services are provided "as is" and "as available" with no warranties of any kind, express or implied. This includes, without limitation, warranties of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, or uninterrupted operation.

The mTSS values, CTL, ATL, TSB, training advice, and other outputs from our Services are estimates and recommendations. They are decision-support tools, not medical advice, performance guarantees, or substitutes for qualified professional judgment. You are solely responsible for how you apply this information in your training.

Always consult a qualified medical professional before beginning, modifying, or intensifying a training program — particularly if you have any underlying health condition, are recovering from injury, or are pregnant. Mountain sports involve inherent risk including risk of serious injury or death; nothing in our Services reduces or eliminates that risk.

We disclaim all warranties on behalf of third parties whose data or services we consume (including Strava and Garmin), and you agree not to seek recourse from those third parties for issues arising from your use of our Services.

Limitation of liability

To the maximum extent permitted by law, Skimo School and its operator are not liable for any consequential, incidental, special, punitive, or indirect damages arising from your use of the Services — including loss of data, lost training time, lost opportunities, personal injury, illness, or any other loss.

If liability cannot be excluded, our total cumulative liability to you for any claim is capped at the greater of $100 USD or the amount you paid us in the past twelve months.

Coaching services (where applicable)

If you engage Skimo School for coaching, additional terms specific to that engagement (scope, duration, payment, cancellation) will be agreed separately. In the absence of a separate agreement, the rights and limitations in these Terms apply, including the no-warranty and limitation-of-liability clauses.

Third-party services

Mountain Metrics integrates with Strava under Strava's API Agreement. Your use of Strava through Mountain Metrics is also subject to Strava's Terms of Service and Privacy Policy. Mountain Metrics is not a Strava product and is not endorsed by Strava.

FIT files uploaded directly to Mountain Metrics are processed via the open FIT specification published by Garmin. Skimo School has no relationship with Garmin and makes no claims of affiliation.

Other Skimo School Services may use third-party providers (email delivery, payment processing) listed in our Privacy Policy.

Charging and payments

The skimoschool.com website, the mailing list, and Mountain Metrics are currently provided free of charge.

If we introduce paid features in the future:

  • Pricing and terms will be presented before purchase
  • For Mountain Metrics specifically, paid features will only gate proprietary value-add functionality (e.g., sport-specific calculators, advanced training tools) — never access to Strava data, in compliance with Strava's API agreement
  • Refund and cancellation policies will be presented at point of sale

Coaching services are paid under separate agreements as noted above.

Changes to the Services

The Services are under active development. Features may change, be added, or be removed without notice. We may discontinue any Service at any time; in that case, we will provide at least 30 days' notice and instructions for exporting your data, where reasonably practicable.

Changes to these Terms

We may update these Terms periodically. Material changes will be communicated via the affected Service or, if substantial, by email. Continued use after a change constitutes acceptance.

Termination

You may stop using any Service and delete your data at any time. We may suspend or terminate access for any user who violates these Terms.

Governing law and jurisdiction

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Delaware, except where mandatory local consumer-protection law requires otherwise.

For users outside the United States: where mandatory law in your country grants you rights or remedies that cannot be waived by contract, those apply notwithstanding the above. For users in California or other US states with strong consumer-protection statutes, the same principle applies.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
